Platform Operator: This platform is operated by Nextwave Digital Group, Inc., a Delaware corporation. Book The Game is a product of Nextwave Digital Group, Inc. References to "Book The Game," "we," "us," or "our" in these Terms refer to Nextwave Digital Group, Inc.
Welcome to Book The Game ("Book The Game," "we," "us," or "our"). Book The Game, a product of Nextwave Digital Group, Inc., is a marketplace platform that connects clients with independent sports photographers and videographers ("Professionals"). Book The Game is a platform that connects users with independent service providers. We do not perform or guarantee services.
Platform Role
Book The Game provides a technology platform only. We do not provide photography or videography services and do not guarantee the quality, availability, or outcome of services performed by Professionals.
User Accounts
Users agree to provide accurate information and maintain the security of their accounts. You are responsible for all activity that occurs under your account.
Independent Contractors
Professionals using Book The Game are independent contractors, not employees, partners, or agents of Book The Game. Professionals control their own pricing, availability, and services.
Payments
Payments are processed securely through third-party payment processors, including Stripe. Book The Game does not store credit card information. Bookings may be paid in full at booking, or by deposit at booking with the remaining balance charged automatically to the saved card. Checkout shows the deposit, remaining balance, and authorization wording, and you must accept it before paying. The balance is charged only after the Professional submits delivered content and marks the booking complete; submitting content alone does not charge the card. The charge never exceeds the amount you authorized, and a larger amount requires new authorization. Only adults aged 18 or older may purchase paid bookings; a minor may be the athlete covered but not the purchaser. Purchaser age is based on the date of birth entered on the account.
A Professional may allow the remaining balance to be paid directly to them by Cash App or Venmo. Those payments take place outside the platform and are solely between the client and the Professional. Deposits are always paid through the platform. Once the Professional records a direct payment, the same balance will not be charged to your card. Any refund of a direct balance must be issued by the Professional. Refunds and cancellations are governed by our Refund & Cancellation Policy.
Some Professionals link their own third-party photo stores (such as Pixieset or ShootProof) from their profile. Photo, download or print purchases made through those stores are not processed by Book The Game, are solely between you, the Professional and that provider, and are not covered by our Refund & Cancellation Policy.
Fees
Book The Game charges no per-booking platform fee; the platform is funded by Pro memberships. Professionals receive card payments minus Stripe's standard card processing fee (currently 2.9% + 30¢ per transaction). We may introduce or change fees with advance notice, and changes will not apply to bookings made before they take effect.
Professional Memberships
Professional memberships are billed monthly through Stripe and renew automatically until cancelled. The Founding Pro membership is $25/month, with the first charge beginning after a 7-day setup period. You may cancel anytime, and access continues through the end of the paid period. A Founding Pro who rejoins within 30 days after the membership actually ends keeps the $25 rate. After that window, returning Pros pay the then-current standard Pro rate (currently $35/month), with no second setup period. If a membership payment fails, paid features (such as marketplace visibility, Boosts, and marketing tools) may be paused until payment succeeds. Existing bookings, payments, and deliveries are not affected. Boosts are optional one-time purchases for a set period.
Media & Intellectual Property
Professionals retain ownership of their work unless otherwise agreed between the parties. Users grant Book The Game a limited, non-exclusive license to store and deliver media for platform functionality, and to display media publicly only where a user chooses to publish it (for example on a public athlete profile, a shared album link, or the Book The Game Feed). Professionals cannot publish client media to the Feed without the booking client's approval.
Minors & Parental Responsibility
Book The Game is intended for users aged 13 and older. Athletes aged 13–17 may create and manage their own account. A parent or legal guardian may also create and manage an account on a minor's behalf, and by doing so accepts these Terms on their behalf.
A parent or legal guardian of a minor may review, make private, or request removal of that athlete's profile and content at any time.
Athletes aged 13 and older may publish a public recruiting profile on their own. Athletes under 13 cannot publish a public profile. A parent or legal guardian of an athlete aged 13–17 may ask us to return that profile to private at any time.
A parent or legal guardian may request removal of a minor's public profile or content at any time. The request process, verification steps, and our response times are described in the Minor Profile Removal & Takedown Requests section of our Privacy Policy.
User Conduct
Users agree not to misuse the platform, engage in fraudulent activity, harass others, upload unlawful content, or violate applicable laws. We reserve the right to suspend or terminate accounts for violations.
Disclaimer of Warranties
Book The Game is provided "as is" and "as available." We make no warranties regarding uninterrupted access, error-free operation, or results from use of the platform.
Limitation of Liability
To the fullest extent permitted by law, Book The Game is not liable for indirect, incidental, or consequential damages arising from use of the platform.
Termination
We may suspend or terminate access to the platform at our discretion for violations of these Terms or applicable law.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. This platform is operated by Nextwave Digital Group, Inc., a Delaware corporation.
